I'm as conservative as they come as relates to debt so I can't argue that all those scenarios fit within "common sense". However... well, I guess there's not much to be gained by prolonging this particular issue. Informed borrowers making informed decisions is the ideal situation, but how often does that actually happen.

It is irrelivant that a substantial amount of homeowners know what they are doing. Ive been to closings. The title agents goes thru every single shred of paper to make sure they understand the terms.

The fact is that JUDGES almost always take the side of the homeowner if they consult an attorney who TELLS them what to say. 'I didnt know' boo hoo etc......

How about, we just dont put people in these DUBIOUS loans, so they cant cry foul afterwards, regardless whether they damn well knew the terms or not.

remember the golden rule:

-its great to GET the mortgage, and the cashout , and whatnot.

-its NOT so great to have to PAY the mortgage.

this is what I have found from sub prime and or otherwise borrowers who go for neg am loans.

If I made all my decisions in life based on what I thought I might be liable for down the road in a court of a law I'd never leave my house or interact with other people.

I tend to live my life in a way that never makes me liable in a court of law. So I never have to fear leaving my house.

Dont sell option arms. Its a start, anyways.

Why would anyone stick up a thread instructing us to sell ALL option arm loans anyways.............
