Credit Bureau Sabotage

I have recently heard about the credit bureaus SELLING private customer information to brokers RIGHT after a mortgage credit report is pulled. It is called buying "trigger data" INFORMATION. A broker buys the lead from the credit bureau and then calls on the customers to steel them away from the original agent giving them a quote. The information is "fresh" because the bureaus can tell that the credit report was recently pulled.

IT HAS HAPPENED TO ME SEVERAL TIMES RECENTLY! I have lost potential customers by this pirating practice. So far it is still legal but I am hoping that enough people will complain and get this practice reversed. If you give a client a quote and they say that within a few days they get "attacked" with phone calls - well then guess what.... your client has been hijacked! Hold on tight cuz it's gonna be a wild ride!

I am in the process of getting legal counsel regarding this matter. So far my stories of "data war" has been recieved with complete shock and horror from every attorney I speak with. HOW CAN THIS BE LEGAL? (It won't be for long!!!) How can my customer's private information be sold? -And without their consent??

Buyers beware. ORIGINATORS BEWARE!

I believe there is a way to opt-out of this on the consumers end. Somebody help me out here... there's a website where you can go to prevent solicitation when you have a credit inquiry.

Seems to me that the default state should be opted-out - and you can choose to opt-in, instead of the other way around.

Yes Opting out will prevent this. It also can increase credit scores by up to 7 points! Advise your customer and have them do it if they want.

THANK YOU SO MUCH! There is hope for this barbaric practice! I will have to have each one call, each time....sigh. -Or do you call FOR them? And do they answer? I know what it is like to get Trans Union to answer the phone!

Let's hope the class action gets underway soon.

Bogus July 1 Email Exposed: The Real Deal on Your Credit File Privacy

Seems like every spring, an anonymous email containing false and misleading information about the use of your personal information shows up in in-boxes across the country, leaving many consumers concerned and confused. It's no wonder: The email message mixes apples and oranges.

Here's what the email says:

"Just wanted to let everyone know who hasn't already heard, the four major credit bureaus in the
U.S. will be allowed, starting July 1, to release your credit info, mailing addresses, phone
numbers... to anyone who requests it. If you would like to "opt out" of this release of info., you
can call 1-888-567-8688. It only takes a couple of minutes to do."

And here's the real deal from the Federal Trade Commission (FTC), the agency that enforces the
Fair Credit Reporting Act (FCRA).

July 1, 2001 was the deadline, under the Gramm-Leach-Bliley Act (GLB), for financial institutions to let you know about their privacy policies and how you could opt out of some of their information-sharing practices (see Privacy Choices for Your Personal Financial Information at ftc.gov/credit). You may recall getting mailings or statement inserts from your financial
institutions, creditors, insurance companies and brokerage firms about this. But the July 1 date is not — and never was — a deadline for consumers to do anything. In fact, consumers can contact their financial institutions anytime to opt out of information sharing practices under GLB.
Credit bureaus can release your credit information only to people with a legitimate business need, as recognized by the FCRA. For example, a company is allowed to get your report if you apply for credit, insurance, employment, or to rent an apartment.
You also can review a copy of your credit report to make sure it's accurate. A recent amendment to the FCRA requires each of the nationwide consumer reporting companies — Equifax, Experian, and TransUnion — to provide you with a free copy of your credit report, at your request, once every 12 months. The companies are rolling this out across the country during a nine-month period. By September 2005, consumers from coast to coast will have access to a free annual credit report if they ask for it. If you're not yet eligible for a free annual credit report under the new federal law, you can buy one. Contact:

Equifax — 800-685-1111 (www.equifax.com)

Experian — 888-397-3742 (www.experian.com)

TransUnion — 800-916-8800 (www.transunion.com)

Your report may cost up to $9.50. Under state law, consumers in Colorado, Georgia, Maine, Maryland, Massachusetts, New Jersey, and Vermont already have free access to their credit reports.

Lenders and insurers also may use information in your credit file as a basis for sending you unsolicited offers of credit or insurance. This practice is known as "prescreening." You can opt out of these offers by calling, toll-free: 1-888-5-OPTOUT (1-888-567-8688) – the same number in the email that goes around every spring. The major credit bureaus use this number to let consumers choose not to receive these "prescreened" or unsolicited credit offers. When you call, you'll be asked to provide certain personal information, including your home telephone number, name, Social Security number, and date of birth. The information you provide is confidential and will be used only to process your request to opt out.

I just called, too. Man I hate those voice recognition systems - they are still too unreliable.
